Dispute Resolution when Children are Involved

When you are trying to decide how to resolve issues arising out of a separation or divorce, and you have children in the home, here are some questions to consider:

  • How will the process I choose help me maintain my children’s family of origin in their hearts and minds, and not destroy it forever?

  • How will the process I choose help me work more closely with my spouse when the case is over, to co-parent our children until they are adults? Or will the process I choose drive us irretrievably apart?

  • How will the process I choose support, or detract from, my children’s emotional wellbeing?

  • Will my children’s loyalties be divided between us, as they try to support each of us in turn? What will be the psychological cost to their growth and development if this happens?

  • If I take my spouse to Court, how will my children cope with the stress of living in a battlefield?

  • If I take my spouse to Court, how will my children feel about me when they are old enough to read the affidavits I have signed about my spouse and his/her relatives?

  • How can I show my children how to engage in conflict in a meaningful and respectful way, so they can use the same skills in their own lives?
