Arbitration
An arbitration is similar to a Court hearing, in that you
are presenting your case to a decision-maker. In arbitration, the decision-maker is an
arbitrator, instead of a Judge.
As an arbitrator, I will be making a final decision as to
what will happen in your life, and I will provide written reasons for my decision.
In an arbitration, your job is not to negotiate, but to persuade.
You must be prepared to lead evidence to support your case, and to make arguments. You may
wish to hire a lawyer or other representative to help you.
In arbitration, you have a say in choosing the arbitrator
who will judge your case. In the Court system, the Judge is assigned to the case by an
administrator, and the parties cannot choose their Judge. Your case can often be decided
sooner in arbitration, as you are free to choose a procedure that is less formal that the
one prescribed by the Rules of Court.
I have trained as an arbitrator, and have arbitrated a
variety of disputes, including construction and commercial contract disputes. I have also
conducted hearings as a member of the Board of Referees, a tribunal that hears appeals
from claims denied by the Employment Insurance Commission of Canada.
